All forms of mobile communications devices, from single purpose cell phones to sophisticated smart phones such as Blackberries, iPhones, iPads or Android devices offer a wealth of digital evidence. As the use of mobile devices has increased the amount of potential digital evidence a typical person produces annually has increased exponentially. Forensic analysis techniques allow for existing, and more impotently, deleted information to be recovered and analyzed from these devices. Details related to e-mail, calls made and received, text messages, contacts, office documents saved, pictures taken, GPS coordinates recorded and voice mails left are but a few of the information items that can be analyzed after-the-fact. The ability to forensically analyze these devices has changed the playing field with respect to the manner in which document production is specified.
Law and Forensics’s team has been amazed at the amount and quality of digital evidence that we frequently obtain from mobile devices. Often this evidence acquired from these devices plays a pivotal role in the litigation process, impacting its outcome more than any other form of digital evidence acquired and analyzed. Being able to prove who said “what,” or “when” they knew about it and “where” they might have been at those times makes the mobile device forensics the cornerstone of any forensic analysis. This realization, along with the expertise our staff brings to the table from a technical perspective, typically results in the “smoking gun” being found sooner than later in most cases – keeping costs low.
While mobile devices can contain a treasure trove of compelling levels of potential evidence, that fact by itself may be an issue, especially when personal privacy rights enter into the equation. Understanding what digital evidence can be examined without violating Federal and State statues is a critical component of our approach to merging the two disciplines for the benefit of our clients.
Our internal mandate is to never produce any digital evidence from any type of communication device that cannot be used in the matter at hand. We are able to achieve this goal because our investigative team consists of experienced attorneys and forensic experts, which is the norm at our company. Considered pioneers in the field of mobile device forensics investigations, our team has conducted numerous electronic forensics examinations involving all forms of mobile devices, published articles covering the new rules for E-Discovery in regards to mobile devices, and given seminars on this emerging field. Whether Blackberry, iPhone, or Droid, our world-class experts know where to find the proper data and how to present it in the most constructive manner
