Daniel Garrie, Senior Managing Partner and General Counsel of Law & Forensics, along with co-author Yoav Griver of Zeichner Elman & Krause LLP, was recently published in the Advocate Magazine: Journal of Consumer Attorneys Association for Southern California. The article, “The Importance of Keyword Selection in eDiscovery” details the greatest pitfalls in the selection of search terms in production of electronic discovery and based on Mr. Garrie’s experience as a neutral and electronic discovery special master, some suggestions “from the trenches” on how to avoid them. Some recommendations include combining a broad search term with a specific file type to increase relevancy of the search, and key preparations for counsel before the “meet and confer.”
Despite the use of tactics, counsel often does not possess the requisite technological knowledge to effectively design keyword search, and relying on the court to determine keyword selection can significantly delay proceedings. In this case an electronic discovery neutral, expert witness, or special master is key, as he or she not only possess both the proper legal and technological knowledge to architect an effective keyword search, but is non adversarial. The neutral wants the search to succeed, without regard to a specific party.
